Terms & Conditions of Service — Camino Academy LLC

By purchasing, booking, or participating in any service offered by Camino Academy LLC (“Camino Academy,” “we,” “our,” or “us”), you (“Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, please do not purchase or use our services.
1. Definitions
Client: Any individual who purchases, books, or participates in services offered by Camino Academy LLC, including coaching clients, course purchasers, and community members.
Coach: The instructor or facilitator providing services on behalf of Camino Academy LLC. Currently, all services are delivered by the Founder, Julio Cesar Manzano.
Session: A single scheduled coaching appointment. Standard sessions are 60 minutes unless otherwise agreed in writing.
Package: A pre-purchased bundle of sessions. Business English coaching packages consist of 5 or 10 sessions. TOEFL prep packages consist of 8 sessions (Kickstart) or 12 sessions (Full Prep).
Digital Course: A self-paced online learning product (video lessons, downloadables, and/or quizzes).
Camino Community: A monthly membership with group sessions, peer access, and/or course access on recurring billing.
Mini-Lesson: A complimentary 15-minute introductory session for prospective clients — real instruction, not a sales pitch.
1.1 Eligibility
Camino Academy provides services to adults only. By booking, purchasing, or participating in any service, you confirm that you are at least 18 years old. Camino Academy does not provide services to minors.
2. Services Offered
Camino Academy provides remote services via video and digital platforms, including:
1-on-1 bilingual coaching (Business English & TOEFL Prep)
Self-paced digital courses
Camino Community membership (monthly)
Free 15-minute mini-lesson for prospective clients
Free and paid webinars and group sessions
Coaching is delivered in English and Spanish (bilingual). We may modify, discontinue, or add services with reasonable notice to active clients.
2.1 Equal Access & Nondiscrimination
Camino Academy offers its educational and coaching services without unlawful discrimination based on race, color, religion, sex (including pregnancy, sexual orientation, and gender identity), national origin, age, disability, veteran status, or any other characteristic protected under applicable U.S. federal or Maryland law, subject to scheduling availability and these Terms.
3. Pricing & Payment
Business English Coaching Rates
Founding rate (first 5 clients): $50/hour
Launch rate: $60/hour
Post-testimonial rate: $75–$85/hour
5-session package: 10% discount on applicable rate
10-session package: 15% discount on applicable rate
TOEFL Prep Packages: Kickstart, 8 sessions for $399. Full Prep, 12 sessions for $579. Package discounts above do not apply to TOEFL packages.
Digital Courses: $49–$149 per course as listed at purchase. Price changes do not affect courses already purchased.
Camino Community: $19–$29/month depending on tier. Auto-renews unless canceled (see Section 7).
Payment Methods: Stripe and/or PayPal. Payment is due at booking (single sessions) or at package purchase. We do not extend credit, send invoices for standard consumer bookings, or accept cash.
4. Scheduling & Attendance
Sessions are booked via Camino Academy’s scheduling tools (including Wix Bookings).
You are responsible for choosing times that fit your schedule. Sessions may be available across time zones, including evenings and weekends.
Sessions begin at the scheduled time. Time lost due to late arrival is not made up.
If the Coach cannot attend, you will be notified as soon as possible, and the session will be rescheduled at no cost.
4.1 Technology Requirements
You need a reliable internet connection, webcam, and microphone. Camino Academy is not responsible for disruptions caused by your technology or internet. Client-side technical interruptions are not automatically rescheduled or credited. Contact the Coach before the next session if issues keep happening.
5. Cancellation & Reschedule
Late Cancellation (under 24 hours): Session is marked completed and deducted from your package or forfeited if a single session.
No-Show: Treated as completed — no refund, credit, or makeup.
Coach Cancellation: Rescheduled at a mutually agreed time at no extra cost.
6. Package Terms
Packages must be used within 90 days (3 months) of purchase.
Unused sessions after 90 days expire and are non-refundable.
Sessions may be transferred to another person upon written request, subject to approval.
Packages are not paused or extended except at Camino Academy’s discretion for documented emergency or hardship.
7. Refund Policy
Coaching Sessions & Packages: Final sale. No refunds for completed, missed, late-canceled, or expired sessions. Unused sessions within the 90-day window may be transferred (Section 6).
Digital Courses: Non-refundable once any content is accessed. If no content was accessed, request a refund within 7 days of purchase at cesar@caminoacademy.net.
Camino Community: Cancel anytime before the next billing cycle. Cancellation takes effect at the end of the current paid period. No partial-month refunds.
8. Session Recording & Consent
With your verbal or written consent, sessions may be recorded for your personal review.
Recordings are not shared publicly or with third parties without your explicit written consent.
Camino Academy may use anonymized, non-identifying themes for marketing. No personally identifiable information will be shared without written consent.
You may opt out of recording at the start of any session.
9. Confidentiality
Information shared in coaching — including personal details, career goals, employment information, and language proficiency — is kept confidential and is not disclosed to third parties without your written consent, except as required by law. You agree to keep proprietary Camino materials confidential.
10. Intellectual Property
All Camino materials (courses, recordings, worksheets, lesson plans, presentations, digital resources) are the intellectual property of Camino Academy LLC.
Personal educational use only.
No copying, distribution, resale, or sharing without prior written consent.
Unauthorized use may result in termination of access and legal action.
11. Limitation of Liability
Services are educational. They are not legal, immigration, employment, or medical advice.
No guarantee of specific outcomes (TOEFL scores, job placement, promotions, immigration decisions, etc.).
You are responsible for how you apply what you learn.
Camino Academy LLC, its owner, and contractors are not liable for direct, indirect, incidental, consequential, or special damages arising from the use of the services.
You agree to indemnify and hold harmless Camino Academy LLC from claims arising from your use of the services.
12. Code of Conduct
Maintain a respectful learning environment:
Treat the Coach and participants with professionalism.
No discrimination, harassment, or abusive language or behavior.
Attend in a distraction-free environment when possible.
Camino Academy may terminate services immediately without refund for abusive, threatening, discriminatory, or otherwise inappropriate behavior.
13. Communication
Primary Channels: cesar@caminoacademy.net and WhatsApp Business.
Response Time: We aim to respond within 24–48 business hours.
Marketing: By purchasing or joining the Community, you may receive occasional marketing emails or WhatsApp broadcasts. Opt out anytime (unsubscribe / reply STOP).
14. Privacy & Data
We collect information needed to deliver and improve services (name, email, phone, payment via Stripe/PayPal, session notes, progress records). Full details: Privacy Policy.
15. Force Majeure
We are not liable for delays or failures due to events beyond reasonable control (natural disasters, outages, government actions, pandemics, etc.). Affected sessions will be rescheduled at no additional cost.
16. Dispute Resolution
Try good-faith direct communication first. If unresolved, disputes go to binding arbitration in Maryland under American Arbitration Association rules. The prevailing party may recover reasonable attorneys’ fees and costs. These Terms are governed by Maryland law, without regard to conflict-of-law principles.
17. Modifications
We may update these Terms. Changes will be emailed to active clients and/or posted on the website. Continued use after a change means you accept the revised Terms. The current version lives on this page.
Acknowledgment
By booking a session, purchasing a package or course, or enrolling in the Camino Community, you confirm that you have read, understood, and agree to these Terms & Conditions in full.
